These Terms of Use govern your use of marshalindia.com and the purchase of services from MarshalWorks (a brand of MS-Marshal Legacy Industries Pvt Ltd). By using this website or engaging our services, you accept these Terms.
Services
We provide B2B services to businesses, including:
- IndiaMART Catalog Rescue & Care — a one-time overhaul of a seller's IndiaMART listings, with optional monthly maintenance.
- Website design — fixed-price website tiers and a Website Care AMC.
- Ad-creative production for agencies (offered later).
Each engagement is defined by the accepted quotation/proposal ("SOW") and, where signed, our Master Service Agreement. Current prices are on our Pricing page; all prices are exclusive of GST, with 18% GST added and quoted explicitly.
Payment
Payment for one-time services is 50% in advance via payment link, UPI or bank transfer, with the remaining 50% due at the mid-project milestone (Catalog Rescue: on evidence-pack delivery; website builds: at design approval). Work begins on receipt of the advance; the final deliverable/go-live is released after full payment. Care Plan and Website Care AMC are billed monthly in advance. Need a different schedule? We're flexible — just ask. A tax invoice is issued under GSTIN 07AAUCM7815N1ZK for every payment. Clients deducting TDS under Section 194J must provide Form 16A; invoice values are gross of TDS. Refunds and cancellations are governed by our Refund & Cancellation Policy.
Your responsibilities
You confirm you are authorised to engage us for the business account concerned, and that the content and access you provide are lawful and yours to share. Platform access (e.g., a monthly OTP-authorized session) is shared by you voluntarily; our handling of it is described in our Privacy Policy.
Third-party platforms
Our services involve third-party tooling operating on your accounts (including IndiaMART). We follow protective protocols (pre-change snapshots, paced changes), but we are not liable for actions taken by third-party platforms on your accounts, and you indemnify us against consequences of platform enforcement arising from work performed under an accepted SOW.
Intellectual property
On full payment you own the final deliverables, including final website content and design. Your domain is registered in your name (we can manage it on your behalf). We retain our tools, templates and know-how. Preview/sample sites built from your business's own public information are deleted or transferred on request. Website hosting under AMC runs on shared/free-tier infrastructure with reasonable-effort uptime (no uptime SLA is offered); 1 revision round is included in the build price.
Limitation of liability
Our total liability is limited to the fees you paid in the 1 month preceding the claim. We are not liable for indirect or consequential loss.
Governing law and jurisdiction
These Terms are governed by the laws of India. The courts of New Delhi have exclusive jurisdiction.
